Schengen area under pressure 2: the Commission recalls the EU nature of the Schengen system

After weeks of tensions between France and Italy regarding the management of Tunisians’ migrants, Nicolas Sarkozy and Silvio Berlusconi sent a joint letter proposing to revise the Schengen rules in order to enlarge the possibility to reintroduce internal border checks. In this commentary, Yves Pascouau, analyses the answer given by the Commission to the letter. It reflects that the Commission rejected Member States attempts to “renationalise” Schengen rules and planned to propose a new scheme based on EU law. Indeed, Schengen is an EU system and rules aiming at modifying the system or limiting free movement within the Schengen area should be decided at EU level.
